Taming the Artificial Intelligence Wild West: The Need for AI Regulation

By: Agastya Rao

“No regulations for Artificial Intelligence in India':

  • Indian IT Minister Ashwini Vaishnaw”

This scary headline is a simple sign of us underestimating the power of AI, and while it has tremendous potential for helping the world, it can also be used for sinister means. So why should we regulate AI, how should we do it, and is it realistically possible?

Why should we regulate Artificial Intelligence?

Well, this one is pretty straightforward. Artificial Intelligence is incredibly powerful and can be manipulated to do simple things like stop traffic lights, scam people and of course wreak nuclear havoc on the world.

Plus with the sudden explosion in companies using and creating Artificial Intelligence it is imperative to ensure that there are rules and regulations in place for Artificial Intelligence, just as we have these for most new technology that is used. More importantly the amount of consumer data that AI is going through per day is shocking. It is safer to err on the side of caution for AI. Is our data and privacy the price to pay to unlock AI’s potential?

How should we regulate it?

Step 1 is a simple one, and that is simply identifying the threat that AI poses, and figuring out potential harms of using and thinking of a few steps to combat them.

Step 2- Is ensuring that we have stricter laws for privacy and data collections. (even if this means having to amend existing laws, which it does). Transparency is key. Companies must notify users that their data is being collected, and we must also have laws in place to set a limit as to how much data companies can harvest. Whether it is search/browsing data to something as extreme as biometric data it is imperative that it is controlled.

However, we must not make the mistake of regulating AI so much that we stifle its potential, too much control can strongly diminish the potential of AI. Afterall, AI can very well be the key tool required for the “next stage of human development”.

Existing laws-

The European Union has released a few rules in order to regulate AI. Starting with identifying AI’s potential, and making a list of banned intrusive and discriminatory uses of AI, such as taking real time biometric data of people. They have also added some exemptions on AI research, which come with open source licenses. This is a great start in terms of regulation for sure, but it will have to be updated regularly, and ofcourse actually implementing these laws is going to be incredibly tough.

How Realistic is the implementation of regulation?

AI is a topic which is at a large scale, and has each and every citizen of Planet Earth as a stakeholder, so naturally people will have different opinions of Artificial Intelligence. A worldwide joint regulation of AI is going to be tough, but is something that the leaders of the world must put their heads together and do. It is also important for them to take the advice of companies currently using or creating Artificial Intelligence, for a holistic perspective, rather than that of one of a frog in a well.

Conclusion-

While AI will not overtake humanity just yet, it is critical to start preparing for regulation of Artificial Intelligence, especially in a country like India which is yet to take any major steps in doing so, and has had issues with dealing with privacy and data in the past.

AI is not going to crawl out of bed and wreak complete havoc tomorrow, but it may happen sometime down the line, and while we should use AI, we should do so judiciously, as it can turn into a truly sinister weapon.
